The PopTalk.Us or JoinPoptalk.com website (the Website or PopTalk Website) and PopTalk mobile applications (the Software or PopTalk Software) are owned and operated by PopTalk, Inc.(“PopTalk”, “us” or “we”). It is PopTalk’s policy to respect your privacy regarding any information we may collect while operating our websites and PopTalk Software.

1. INTRODUCTION

We, PopTalk Corporation (“PopTalk,” “we,” “us,” or “our), believe your privacy is very important. To fulfill our commitment to respecting and protecting your privacy, we will adhere to our basic principles as explained in detail below, and crafted this Privacy Policy in accordance with these basic principles:

a. We inform you of the personal information that will be collected, and seek your consent to collect, use, or disclose your personal information.

b. We identify the purposes of use for collecting your personal information.

c. We collect only information that is necessary to carry out the identified purposes of use.

d. We use or disclose your personal information only for the purposes for which it is collected, except with your consent or as required or permitted by law, and we will keep your information only as long as necessary to fulfill those purposes.

e. We endeavor to make sure that your personal information is accurate, complete, and up-to-date.

f. We protect your personal information by appropriate security safeguards.

g. We make our policies and practices for the handling of your personal information as transparent as possible.

h. You will have access to your personal information and will be able to correct your personal information as appropriate.

j. We will be accountable to you. We are always interested in hearing your opinion regarding our compliance with these principles, this Privacy Policy, and applicable law.

2. WHAT THIS PRIVACY POLICY APPLIES TO

a. What Is This Privacy Policy?

This Privacy Policy explains how PopTalk will handle and safeguard your personal information, and the choices you have to access and control your personal information. This Privacy Policy applies to: personal information you provide us when you use the PopTalk Messenger app (“PopTalk App”), optional services made available within the PopTalk App, and other apps that integrate with or work in conjunction with the PopTalk App (collectively “Apps”); personal information you provide us when you visit websites maintained by us relating to our Apps (“Websites”) (Apps and Websites are collectively referred to as the “Service”); and personal information about you provided by users of the Service.

b. What Privacy Policy Applies to Other PopTalk Services?

Users may request additional services from PopTalk or PopTalk affiliates. Because the needs and choices of each user vary, we provide separate privacy policies or addendums to this Privacy Policy for certain additional services. The separate privacy policies and addendums explain the types of information we collect, their purposes of use, and other policies that may apply to that service. When you choose to use an additional service, you will be informed of the applicable privacy policy or addendum, which applies in addition to and may modify this Privacy Policy, before you can access the additional service. Please note that, you can check your applicable privacy policy or addendum within the Apps that you are using or Websites you are visiting.

c. How Does PopTalk Use My Information?

To provide the Service, PopTalk, as a data controller or joint data controller, uses your information for the following purposes:

  • to provide you the Service via your mobile phone or personal computer and to allow you to transmit your user-generated content to other PopTalk users;

  • to verify your identity;

  • to allow you to use your PopTalk account on multiple devices and transfer your PopTalk account to another device;

  • to help you find people you know that already are PopTalk users so that you can connect using PopTalk; and, upon your request, to allow other PopTalk users to connect with you;

  • to enable you to sync other applications offered by PopTalk, PopTalk affiliates, and PopTalk business partners together with your PopTalk account and to share information between the applications you use;

  • to respond to requests you may make to use services provided by PopTalk other than the PopTalk app service;

  • to detect and deter unauthorized or fraudulent use of or abuse of the Service;

  • to improve and/or optimize the Service;

  • to enable us to provide customer support, and to respond effectively to your inquiries and claims;

  • to conduct user satisfaction surveys;

  • to provide you with information regarding the Service;

  • to measure the effectiveness of advertisements that we place on the Internet or in other media;

  • to notify users of any other important information regarding the Service, if necessary;

  • to identify winners of promotional contests, to send gifts to those winners, and to deliver purchased products and the like;

  • to aggregate anonymized statistical data regarding the Service; and to comply with applicable laws or legal obligations.

If, however, we provide you with more specific purpose(s) of use either at the time we ask you to provide your personal information or through another means, then such notice will take precedence over the general purposes of use stated in Section 4.a of this Privacy Policy.

d. How Does PopTalk Protect My Information?

To fulfill our commitment to respecting and protecting your privacy and the confidentiality of your information, PopTalk has implemented industry-standard safeguards to prevent unauthorized access or disclosure, misuse, alternation, or destruction of your information. Because no method of electronic transmission or method of data storage is perfect or impenetrable, we cannot guarantee that your information will be absolutely safe from intrusion during transmission or while stored in our systems.

To help protect your privacy and confidentiality of your information, we also need to ask for your cooperation regarding the following: Please do not share your password with others or use the same passwords you use for other services. Also, please notify us in the event you suspect any unauthorized use of your account or any other breach of security.

i. Website Visitors

Like most website operators, PopTalk collects non-personally-identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor requests. PopTalk’s purpose in collecting non-personally identifying information is to better understand how PopTalk’s visitors use its website. From time to time, PopTalk may release non-personally-identifying information in the aggregate, e.g., by publishing a report on trends in the usage of its website.

PopTalk also collects potentially personally-identifying information like Internet Protocol (IP) addresses and email addresses for users who post feedback or report an issue on the Website.

ii. PopTalk Software Users

When you install PopTalk Software on your mobile device, you are required to provide a mobile phone number to receive access code via SMS. The phone number will be saved in PopTalk servers. The phone number is also used to discover other PopTalk users who have your phone number in their address book.

You need to permit PopTalk to access your address book in the mobile device. A simplified copy of the address book with information of name, phone number, ringtone of each contact will be stored in PopTalk servers. The phone numbers and name of your contacts are used to build your PopTalk friend list.

PopTalk also collects information such as the mobile device ID, device name, OS type and version, and IP address to make certain PopTalk functions work.

PopTalk does not disclose, release your phone number, contacts information, or device information to any third parties.

Certain PopTalk features require access to the location information for your mobile phone.

When you use PopTalk to send a multimedia message (such as sharing a picture, or sharing a video clip), the multimedia content will be cached in PopTalk servers for increased performance. The cached content will be removed after a certain period of months, PopTalk does not provide any means for you to delete the cached content manually.

iii. Gathering of Personally-Identifying Information

Certain visitors to PopTalk’s websites, or PopTalk Software users choose to interact with PopTalk in ways that require PopTalk to gather personally-identifying information. The amount and type of information that PopTalk gathers depends on the nature of the interaction. PopTalk collects such information only insofar as is necessary or appropriate to fulfill the purpose of the user’s interaction with PopTalk. PopTalk does not disclose personally-identifying information other than as described below. Visitors can always refuse to supply personally-identifying information, with the caveat that it may prevent them from engaging in certain website-related activities.

iv. Analytics for users

PopTalk may collect statistics about the behavior of visitors to its websites or PopTalk Software users. PopTalk may display this information publicly or provide it to others. However, PopTalk does not disclose personally-identifying information other than as described below.

v. Protection of Certain Personally-Identifying Information

PopTalk discloses potentially personally-identifying and personally-identifying information only to those of its employees, contractors and affiliated organizations that :

Need to know that information in order to process it on PopTalk’s behalf or to provide services available at PopTalk’s websites or PopTalk Software. That have agreed not to disclose it to others.

Some of those employees, contractors and affiliated organizations may be located outside of your home country. By using PopTalk’s websites or PopTalk Software, you consent to the transfer of such information to them. PopTalk will not rent or sell potentially personally-identifying and personally-identifying information to anyone other than to its employees, contractors and affiliated organizations as described above.

PopTalk discloses potentially personally-identifying and personally-identifying information only in response to a subpoena, court order or other governmental request, or when PopTalk believes in good faith that disclosure is reasonably necessary to protect the property or rights of PopTalk, third parties or the public at large. If you are a registered user of a PopTalk website and have supplied your email address, PopTalk may occasionally send you an email to tell you about new features, solicit your feedback, or just keep you up to date with what’s going on with PopTalk and our products.

We expect to keep this type of email to a minimum. If you are a PopTalk Software user, PopTalk may occasionally send you Push Notification to tell you about new features, solicit your feedback, or just keep you up to date with what’s going on with PopTalk and our products. If you send us a request (for example via a support email or via one of our feedback mechanisms), we reserve the right to publish it in order to help us clarify or respond to your request or to help us support other users. PopTalk takes all measures reasonably necessary to protect against the unauthorized access, use, alteration or destruction of potentially personally-identifying and personally-identifying information.

vi. Cookies

A cookie is a string of information that a website stores on a visitor’s computer, and that the visitor’s browser provides to the website each time the visitor returns. PopTalk uses cookies to help PopTalk identify and track visitors, their usage of PopTalk website, and their website access preferences. PopTalk visitors who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using PopTalk’s websites, with the drawback that certain features of PopTalk’s websites may not function properly without the aid of cookies.

vii. Business Transfers

If PopTalk, or substantially all of its assets were acquired, or in the unlikely event that PopTalk goes out of business or enters bankruptcy, user information would be one of the assets that would be transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of PopTalk may continue to use your personal information as set forth in this policy.

viii. Ads

Ads appearing on PopTalk Software or any of our websites may be delivered to users by advertising partners, who may set cookies. These cookies allow the ad server to recognize your computer each time they send you an online advertisement to compile information about you or others who use your computer. This information allows ad networks to, among other things, deliver targeted advertisements that they believe will be of most interest to you. This Privacy Policy covers the use of cookies by PopTalk and does not cover the use of cookies by any advertisers.

Privacy Policy Changes

PopTalk may change its Privacy Policy from time to time, and at PopTalk’s sole discretion. PopTalk encourages visitors or users to frequently check this page for any changes to its Privacy Policy. Your continued access to the Website or using of the Software after any change in this Privacy Policy will constitute your acceptance of such a change.
